General Terms and Conditions

Draft – applies from the start of the paid offer and will be reviewed by a lawyer beforehand. The free model suggestion is governed by the Usage notes.

§ 1 Scope and provider

(1) These terms apply to all contracts for paid services of Catamaran Radar that you conclude via this website with WE SUCCESS Consulting GmbH, Wachaustr. 11, 70469 Stuttgart ("we").

(2) Deviating terms of the customer do not apply, even if we do not expressly object to them.

(3) A consumer is any natural person who concludes the contract for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 BGB).

§ 2 Service

(1) For the project you describe in the questionnaire, we offer:

  • Model suggestion (free of charge): on the website we show you models that, in our assessment, match your details, with a short assessment and key figures. The model suggestion is not a contract; the following apply: Usage notes.
  • Shortlist (one-off): a list of ten available used catamarans that, according to our assessment, best match your plans, with boats of the models you have selected first. If there are fewer than ten of these, we add suitable boats of other models and mark them as such. If you select "Only boats of my selected models" when ordering, the list may contain fewer than ten boats. For each boat, the shortlist states what, in our assessment, speaks in favour of the boat, a brief assessment in four areas, photos from the advert, a link to the original advert and a link to order a pre-purchase review for the boat; delivered as a PDF by e-mail. The shortlist is not a complete assessment of the boats: risks and known weaknesses are examined only by the pre-purchase review.
  • Pre-purchase review (one-off): a complete pre-purchase review for one boat, as a PDF by e-mail – for a boat from your shortlist, for a listing whose link you provide, or for the boat that, in our assessment, best matches your purchase request. If the specified listing is not yet in our records, we retrieve it once from the portal for your order. The pre-purchase review is possible for used sailing catamarans on portals that we support and for models for which we have model data.
  • Package (one-off): a pre-purchase review as above and additionally a code for two further pre-purchase reviews. The code can be redeemed for any pre-purchase review, for any boats, and is valid for three years from the end of the year in which you purchased the package.
  • Search assistant (subscription, cancellable monthly): follows later; the rules in § 4a then apply in addition.

Offsetting: if you order a pre-purchase review for a boat from a shortlist within 30 days of purchasing that shortlist, we offset the price of the shortlist against this first pre-purchase review. It is then free of charge for you. A separate contract is also concluded for this, with the same confirmations as for a paid order.

The exact scope and the price are stated in the product description on the order page.

(2) The reports are automated preliminary reviews based on public listing details and our model data as of the stated data status. They are not a survey, not an inspection and not legal, tax, financial or investment advice. We do not broker boats. Details are set out in the usage notes, which form part of this contract.

(3) We owe the preparation of the reports according to the described rules from the data available as of the data status. We do not owe a specific purchase success, the availability of a boat or the accuracy of third-party details in the listings.

§ 3 Conclusion of contract

(1) The presentation of the services on the website is not yet a binding offer.

(2) You describe your purchase request, check your details in the overview, can correct them there using "Back", agree to these terms and submit a binding offer by clicking "order subject to payment".

(3) The contract is concluded when we confirm your order by e-mail. The confirmation contains the contract content, these terms and the usage notes in the version applicable to you.

(4) The contract language is German. We store the contract text together with your order for 30 days; thereafter it is available to you only via the confirmation e-mail. You can find the respectively valid version of these terms on this page at any time.

§ 4 Prices and payment

(1) The price displayed at the time of ordering applies. All prices include statutory VAT. No shipping costs are incurred.

(2) Payment is made in advance via the payment service provider named on the order page. We do not receive card data or bank details. You will receive an invoice by e-mail.

§ 4a Search companion (subscription)

Applies only once the search companion is offered.

(1) The search companion runs for an indefinite period and may be cancelled by either party at any time with effect from the end of the current billing month. The fee is due monthly in advance.

(2) You can cancel online via the "Cancel contracts here" button on this website, and also in text form (e.g. by e-mail). We confirm receipt of your cancellation without undue delay by e-mail, stating the date and time at which the contract ends.

§ 5 Provision

We send the reports to the confirmed e-mail address after receipt of payment, usually within 24 hours. If a selected boat is no longer available before dispatch, we replace it with the next matching boat. If a report does not pass our quality check, we review it manually; this may delay delivery, and we will then inform you by e-mail. For the pre-purchase review, we check where possible before payment whether the listing concerns a sailing catamaran, whether we support the portal and whether we know the model; if this only emerges afterwards, we refund the price automatically and in full; a code used is credited again. If we cannot provide the service (for example because no matching boat is available), we refund the price in full.

§ 6 Right of withdrawal

Consumers have a right of withdrawal. Details and the model withdrawal form can be found in the cancellation policyThe right of withdrawal expires early if we have started preparing the reports after you have expressly consented to us starting before the end of the withdrawal period, you have confirmed your awareness that you thereby lose your right of withdrawal, and we have provided you with confirmation of this.

For the package, early expiry applies only to the pre-purchase reviews that we have already started preparing. If you withdraw the package within the withdrawal period, we will refund one third of the package price for each pre-purchase review not yet redeemed; the code becomes invalid to that extent.

§ 7 Your cooperation

Please provide your details in the questionnaire truthfully; the shortlist and the reports are based on them. We are not liable for the consequences of incorrect or incomplete information in the questionnaire.

§ 8 Defects

The statutory rights for defects in digital products apply (§§ 327 et seq. BGB). Please report errors to info@we-success.de; we will correct the report and send it again.

§ 9 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any warranty expressly assumed by us.

(2) In the case of slightly negligent breach of a material contractual obligation, our liability is limited to the foreseeable, contract-typical damage at the time of conclusion of the contract. Material contractual obligations are obligations whose fulfilment is essential to the proper performance of the contract and on whose compliance you may regularly rely – here in particular the preparation of the reports in accordance with the described rules from the data available at the data cut-off date.

(3) Otherwise, liability for slight negligence is excluded.

(4) We do not warrant the accuracy of the details that sellers, brokers and portals provide in their listings. We adopt these details, check them for contradictions, but cannot verify them on the boat.

(5) The limitations of liability also apply to our employees and vicarious agents.

§ 10 Rights of use

You receive a simple, non-transferable right to use the reports for your personal purchase decision, to store them, to print them and to pass them on to persons advising you in this matter. Publication or commercial distribution requires our consent.

§ 11 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only to the extent that it does not deprive you of the protection of mandatory provisions of the law of the country in which you have your habitual residence.

(2) If you are a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction is Stuttgart.

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
